On November 7, 2024, a federal district court in Texas struck down the Biden Administration’s Keeping Families Together parole in place program. The ruling comes after the court’s earlier temporary halt to the program. The Biden Administration may appeal this decision. We will provide an update once more information is available.

New forms were not developed for this program and the only way to submit an application for parole in place is through the USCIS website. At the end of the questionnaire we will tell you if it looks like you’re eligible for parole and provide some recommendations around what you should think about doing next.   • What is parole and how does it help undocumented people with a green card?
  • A parole application is a legal request to stay in the United States and forgive your last unlawful entry. If you are granted parole under this new program, you will be able to obtain work authorization and will have a three-year time period to apply for a green card through the adjustment of status process. It is important to remember that obtaining parole is the first step in this process, and only provides a temporary time period to apply for a green card and become a lawful permanent resident. Additionally, because immigration laws and policies can change rapidly after the election cycle ends it is critical to act now to understand your eligibility for parole and your chances of being approved for a future green card.   • How is this parole in place program different from legal permanent residency?
  • As mentioned above, parole is simply a request to lawfully remain in the United States. While a successful applicant will be authorized to stay in the United States, that authorized stay will only last for a limited period of time. Additionally, any work authorization you receive as part of having your parole request granted will also be temporary. To lawfully remain present in the United States and keep the ability to work past your parole duration you will need to adjust your status.

  • Immigration laws in the United States can be complicated and submitting a parole application might at first seem like a good idea. However, it is important that you understand the obstacles you might face if you submit a parole application and potentially a future green card application. Our system is designed to help screen your background for issues that you might not be thinking about. And at the end of the questionnaire, based on the information you provided, we’ll tell you if it looks like you’re eligible and provide you with options to address any tricky situations that you told us about. Please note, that immigration authorities have already indicated that parole applicants that have potentially serious criminal histories and/or other concerns in their background will be referred to law enforcement.
  • How long does it take for USCIS to process my parole application?
  • USCIS only recently launched the parole in place program for undocumented spouses and children. We do not yet know how long it will take USCIS to process these applications. However, to ensure your application is processed as quickly as possible be sure to submit all of your supporting evidence with your initial application. If USCIS has to reach out to you for more evidence or information it will take the agency longer to process your application.
