SimpleCitizen, Inc. (“SimpleCitizen”) is committed to protecting your privacy. We have prepared this Privacy Policy to describe our practices regarding the personal information that may be collected from users of our websites which post this Privacy Policy, including https://www.simplecitizen.com (“Website”), SimpleCitizen’s iOS, Android, and other mobile applications (“Apps”), and other related services (collectively, the “Services”). By submitting personal information through the Services, as a SimpleCitizen customer (“You”), you expressly consent to the processing of your personal information in the U.S. in accordance with this Privacy Policy. The use of personal information collected through our service shall be limited to the purposes described in this Privacy Policy. This Privacy Policy forms part of the SimpleCitizen Terms and Conditions of Use.
IMPORTANT NOTICE REGARDING CHILDREN UNDER 13: This Privacy Policy generally applies to the users of our Services. 2.1 Cookies: Cookies are text files that websites store on a visitor’s device to uniquely identify the visitor’s browser or to store information or settings in the browser for the purpose of tracking user activity and patterns, helping the visitor navigate between pages efficiently, remembering preferences, improving the visitor’s browsing experience, and enabling functionality, analytics, and targeted advertising. Cookies used on our Websites include cookies that we serve as well as cookies served by third parties that we work with to enable the services they provide, such as analytics services that track traffic and usage. 2.3 “Web Beacons”: Web Beacons are digital images we use to log information on our Website and in our emails. They are typically used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked, typically to compile statistics about usage of websites and the success of marketing campaigns. We use web beacons to manage cookies, count visits, and to learn what marketing works and what does not. We also use web beacons to tell if you open or act on our emails.
2.4 “Flash Cookies”: Flash Cookies are used to store your preferences such as volume control or to display content based upon what you view on our websites to personalize your visit. 2.5 Browser web storage: (Including HTML5), also known as locally stored objects, functions like cookies but enables the storage of a larger amount of data.
2.6 Session replay: We use third party software code to record users’ interactions with the Websites in a manner that allows us to watch and analyze visual reconstructions of those user sessions. The replays include users’ clicks, mobile app touches, mouse movements, scrolls, and keystrokes/key touches during those sessions. 2.7 Chatbot features: The Websites provide users with chatbots that you can use to get information and support. The Services include AI products/features that utilize third party AI companies’ technology (“Third Party AI Providers”) and/or SimpleCitizen's proprietary technology (“AI Products”), which are governed by the terms set out below. If you use artificial intelligence features in certain SimpleCitizen products and services and any others identified on the SimpleCitizen.com website as featuring the use of AI technology (the “AI Services”), our Terms and the following additional terms (“AI Additional Terms”) apply to you. Please read them carefully.
6.1 Processing by Third Party AI Providers. Third Party AI Providers act as sub-processors of any personal data contained in Input (as defined below). All personal data processing activities by Third Party AI Providers will be governed by the DPA in place, if any, between SimpleCitizen and the Subprocessor. A current list of Third Party AI Providers is found in our Subprocessors List. When using AI Services your data will be sent to such Third Party AI Providers.
6.2 Input and Output. Any data, content and information (in any format) submitted to the SimpleCitizen service by you, your permitted users, including, but not limited to, questionnaire entries and conversation data (including any personal data contained therein) (“Input”) and results generated by an AI Product based on such Input (“Output”) are deemed customer data under the Terms and subject to the rights, restrictions and obligations applicable described within the Terms and this privacy policy. You will only provide and/or instruct SimpleCitizen to use Input and Output where the Customer is authorized to provide such content to SimpleCitizen for the purposes set out in the Terms. Third parties may submit information or materials to an AI Product that generate results that are identical or similar to Output (“Third-Party Results”), and you acknowledge you have no right, title or interest in or to any Third-Party Results.
6.3 Accuracy of AI Services. Output may contain material inaccuracies and may not reflect correct, current or complete information. Do not rely, or encourage others to rely, on any Output without independently evaluating its accuracy and appropriateness of use, including, without limitation, by using human review. SimpleCitizen makes no representations or warranties and provides no indemnities with respect to Output. The AI Products and Output are not intended to substitute for the services of properly trained and licensed individuals.
6.4 AI Services Are Not Legal Advice. The AI Services do not provide legal advice. They are for informational purposes only and should not be considered a substitute for advice from a qualified professional.
6.5 No Warranty for AI Services. The AI Services use generative artificial intelligence, which is a new and rapidly evolving technology. SimpleCitizen provides the AI Services on an “as is” basis and makes no warranty or promise that the content generated by the AI Services will be accurate, complete, error-free, or fit for a particular use.
6.6 Use of AI Services Do Not Create Attorney-Client Privilege. The AI Services are not intended to process or protect information that may be subject to attorney-client privilege.
6.7 Rights to Use. You permit Third Party AI Providers to use the Input to deliver Output, comply with applicable laws, and enforce their respective policies. SimpleCitizen contractually restricts Third Party AI Providers from using customer data for training or otherwise improving Third Party AI Provider's services.
6.8 Restrictions on Use of AI Services. In addition to any general obligations and restrictions pertaining to your use of Services under the Terms, you represent and warrant that:
You will not use the AI Services to create, upload, or share any content that (a) is libelous, defamatory, obscene, pornographic, abusive or threatening; (b) advocates or encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national or foreign law or regulation; (c) promotes or facilitates scams, phishing, malware, or other deceptive or fraudulent activities; (d) is intended to misinform, misrepresent, or mislead others; or (e) infringes upon the intellectual property rights of others.
You will not, nor permit others to, use the AI Products or any Outputs in violation of SimpleCitizen's Terms nor any relevant third party terms, policies or other agreements applicable to your use of the AI Products (as set out below and incorporated herein) as may be referred to in our Terms and which may be updated from time to time:

We are required under the Children’s Online Privacy Protection Act (“COPPA”), with limited exceptions, to obtain verifiable parental consent in order to collect, use or disclose personal information from Children. The Services are not directed at Children, and SimpleCitizen does not knowingly collect any information from Children.
